{"id":7972,"date":"2022-08-26T11:45:45","date_gmt":"2022-08-26T06:15:45","guid":{"rendered":"https:\/\/itechindia.co\/us\/?p=7972"},"modified":"2025-09-24T06:39:25","modified_gmt":"2025-09-24T06:39:25","slug":"why-the-cures-act-final-rule-makes-ehr-interoperability-a-must-for-clinicians","status":"publish","type":"post","link":"https:\/\/itechindia.co\/us\/blog\/cures-act-final-rule-for-ehr-interoperability\/","title":{"rendered":"Why the Cures Act Final Rule Makes EHR Interoperability a Must for Clinicians"},"content":{"rendered":"<p><center><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-6623\" src=\"https:\/\/itechindia.co\/us\/wp-content\/uploads\/2022\/08\/Cures-Act-Final-Rul-for-EHR-Interoperability.jpeg\" alt=\"Cures Act Final Rule for EHR Interoperability\" width=\"882\" height=\"588\" \/><\/center><span style=\"font-weight: 400;\">All healthcare providers in America must make <\/span><b>electronic health information sharable by October 6, 2022<\/b><span style=\"font-weight: 400;\">, in a rigorous implementation of the ONC Interoperability Rule. <\/span><span style=\"font-weight: 400;\">The <\/span><b>Office of the National Coordinator for Health Information Technology<\/b><span style=\"font-weight: 400;\">, abbreviated ONC, is an entity within the U.S. Department of Health and Human Services (HHS).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In <\/span><b>2016, Congress passed the 21st Century Cures Act<\/b><span style=\"font-weight: 400;\"> which became the impetus behind making patient health data electronically accessible. The Cures Act Final Rule was announced in 2020 and has a provision for making patient data transferrable across healthcare platforms and to patients&#8217; smartphone devices as well, at no cost.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0EHR Interoperability gives patients more choices in their healthcare by not making them locked into one provider. Making health data available across different vendor platforms as well as <\/span><b>patient smartphone devices<\/b><span style=\"font-weight: 400;\"> has many challenges. The foremost is the necessity for the healthcare industry to adopt <\/span><b>standardized APIs<\/b><span style=\"font-weight: 400;\"> in healthcare (application programming interphases) that facilitate information exchange.\u00a0\u00a0<\/span><\/p>\n<h2><b>What the Cures Act Final Rule means for clinicians<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Since the Cure Act Final Rule specifically pertains to the interoperability of EHR systems, it means that the EHR of one provider should be able to electronically transfer data in a safe and secure way to another provider\u2019s system. The act also defines <\/span><b>information blocking <\/b><span style=\"font-weight: 400;\">and the penalties that can accrue from it as well as the exceptions where information blocking is allowed.\u00a0 <\/span><span style=\"font-weight: 400;\">If a practice has data that is not \u2018liquid\u2019, it could be considered a data blocker under the <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/05\/01\/2020-07419\/21st-century-cures-act-interoperability-information-blocking-and-the-onc-health-it-certification\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Cures Act<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<blockquote><p>39% of Health Providers surveyed say they are unaware that they could incur civil monetary penalties for information blocking practices &#8211; Life Image Survey 2021<\/p><\/blockquote>\n<p><center><img decoding=\"async\" class=\"alignnone size-full wp-image-6623\" src=\"https:\/\/itechindia.co\/us\/wp-content\/uploads\/2022\/08\/Cures-Act-Final-Rule-Cheatsheet.jpeg\" alt=\"Cures Act Final Rule Cheatsheet\" width=\"882\" height=\"588\" \/><\/center><\/p>\n<h2><b>Challenges implementing EHR interoperability and how to overcome it<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The necessity for <a title=\"A Guide to Switching Tech Vendors With Minimum Risk To Your Business\" href=\"https:\/\/itechindia.co\/us\/blog\/how-to-switch-it-service-provider-with-minimal-risk\/\">software vendors<\/a> to make their platforms interoperable is very clear. However, while the need is understood, many existing EHR solutions might not be built for interoperability.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A <\/span><b>survey sent out in March 2021 to 4,000 technology and administrative leaders<\/b><span style=\"font-weight: 400;\"> in the healthcare sector in the US indicates that many organizations do not meet even the basic interoperability standards. These are the challenges that many clinicians face with their EHR systems:<\/span><\/p>\n<h3><b>1. Inconsistent data formats that cannot be recognized <\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Many EHR systems may possess <\/span><b>foundational interoperability<\/b><span style=\"font-weight: 400;\"> i.e a direct data exchange channel can be set up between different EHR systems. However, the data cannot be automatically processed. For instance, if an OTC medication prescription is sent across in a pdf format, the receiving system can store the information but cannot act on it. This basic level of interoperability in healthcare does not expedite the diagnostic process.<\/span><\/p>\n<blockquote><p>66% of healthcare organizations say that they still use paper rather than digital solutions to share healthcare data with patients. &#8211; Life Image Survey 2021<\/p><\/blockquote>\n<p><b>Solution: <\/b><span style=\"font-weight: 400;\">Consider software upgrades that can consistently pull data from different silos and convert them into uniform data sets that can be recognized across networks. Security and privacy concerns in sharing sensitive data\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Cures Act Final Rule\u2019s requirement is that patients get <\/span><b>on-demand access<\/b><span style=\"font-weight: 400;\"> to the information within their medical records. This throws up a complex issue on data privacy. When is it okay to respond to electronic requests for patient information?\u00a0<\/span><\/p>\n<p><b>Solution: F<\/b><span style=\"font-weight: 400;\">rom the technology standpoint, you will need an EHR solution that verifies the data requests and uses an <\/span><b>OAuth 2.0 authorization protocol <\/b><span style=\"font-weight: 400;\">to permit or deny electronic requests to access data as well as limit what data can be shared. Organizational resistance to sharing data\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">There is a reluctance among some health providers to share data. This could be because of the additional technology upgrades and human supervision it would require.
